Last Will and Testament of John Millenbaugh State of Indiana ) S. S. County of Huntington ) I John Millenbaugh of sound mind and memory of Huntington County in the State of Indian acknowledging the the One God as the Creator and Devine Ruler of the Universe, do hereby make this my last Will and testament. After payment of all my just debts and personal charges, funeral expenses and last sickness, I devise, bequeath, and dispose of all my estate as follows, to wit. First: to my wife Helen Millenbaugh I bequest all of my personal property including household furniture and everything now pertaining to my home and house in the City of Huntington, Indiana. Second: I devise and bequeathe to my beloved wife Helen Millenbaugh to have the same for and during her natural life the following Real Estate situate in the City of Huntington, County of Huntington, and State of Indiana to wit: Out Lot numbered (11) eleven in Ewing's Addition of out lots to the town now City of Huntington, Indiana, said property being the lot or panel of land on which our home now stands. It being my intention to give and bequeath to my beloved wife Helen Millenbaugh a life estate in said property above described with remainder over to the persons named in item 3 of this will. Three: And the remainder in fee simple of said panel or lot of land described in Item two I devise and bequeath as follows: To Christina Murphy, Catherine Wagoner, and Julia Feigert each a one fourth interest in fee and wimple except as to Julia Feigert she to receive a one fourth interest after deducting the sum of One Hundred Dollars. To Maggie Millenbaugh and Julia Millenbaugh heirs of my late son John A. Millenbaugh a one fourth interest together and in addition thereto in the final settlement of my estate to Maggie Millenbaugh the sum of $170 and to Julia the sum of $120.00 I hereby appoint and designate Helen Millenbaugh as my executor, to perform the trust of the will. A Yopst State of Indiana ) S.S Huntington County ) Be it Remembered That on the 2d day of Janruary 1896, George Baley one of the subscribing witnesses to the within and foregoing last Will and Testament of John Millenbaugh late of said County, deceased, personally appeared before William Moffett, Clerk of the Circuit Court of Huntington County, in the State of Indiana, and being duly sworn by the Clerk of said Court, upon his oath declared and testified as follows, that is to say: That on the 20" day of August 1894 he saw the said John Millenbaugh sign his name to said instrument in writing as and for his last Will and Testament; and that this deponent at the same time heard the said John Millenbaugh declare the said instrument in writing to be his last Will and Testament, and that the said instrument in writing was at the same time at the request of the said John Millenbaugh and with his consent attested and subscribed by the said George Baley and George A Yopst in the presence of said testator, and in the presence of each as subscribing witnesses thereto, and that the said John Millenbaugh was, at the time of signing and subscribing of said instrument in writing as a aforesaid of full age, (that is, more than twenty-one years of age,) and of sound and disposing mind and memory, and not under any coercion or restraint, as the said deponent verily believes, and further deponent says not. Moffett Clerk Circuit Court of Huntington County Deputy By State of Indiana, Huntington County, SS: In the Matter of the Estate of John Millenbaugh Deceased Helen Millenbaugh says that John Millenbaugh died on the 23rd day of December 1895 ?estate, she further says she is the widow of said decedent that they had and have children which are now living. She further says that as the widow of said decedent under the law she is entitled to the undivided one third part of the real estate of which decedent died seized and that she is also entitled to her statutory allowance of Five hundred dollars out of the personal estate of decedent and she now says that she elects to take under the statute the part to which she is entitled and not under the provisions of the Will of decedent.
